1. Agreement to Terms

By accessing or using eatby.ai, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our platform. These terms apply to all users, including guests, home cooks, and visitors.

2. Description of Service

eatby.ai is a marketplace platform that connects guests seeking home-cooked meals with home cooks who offer meal experiences. eatby.ai does not prepare food, employ cooks, or act as a food service provider. We provide the platform, payment infrastructure, and communication tools to facilitate transactions between users.

3. User accounts

To use certain features, you must create an account. You agree to:

• Provide accurate, complete, and current account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized account access
• Be at least 18 years old to create an account
• Not create multiple accounts or accounts on behalf of others

4. Cook responsibilities

If you list meals as a cook, you agree to:

• Accurately describe your meals, including ingredients, allergens, and preparation methods
• Comply with all local food safety, health, and licensing regulations
• Maintain a clean, safe cooking environment
• Disclose all 14 major allergens present in your dishes
• Honour confirmed bookings or cancel with adequate notice
• Communicate professionally and promptly with guests
• Not circumvent the platform to take payments outside of eatby.ai

5. Guest responsibilities

As a guest, you agree to:

• Arrive on time for dine-in bookings
• Notify cooks of any dietary requirements before booking
• Treat cooks and their homes/kitchens with respect
• Only book meals for the number of guests specified
• Leave honest, fair reviews based on your actual experience
• Not attempt to obtain refunds fraudulently

6. Payments

All payments are processed by Stripe. Guests are charged at the time of booking. Cook earnings are disbursed 24 hours after a completed meal. eatby.ai charges a service fee on each booking to cover platform costs and guest protection. All fees are clearly displayed before confirmation.

7. Cancellations and refunds

Refunds are governed by the cook's cancellation policy (Flexible, Moderate, or Strict), which is displayed on each listing. If a cook cancels, guests receive a full refund regardless of the policy. eatby.ai reserves the right to issue refunds in cases of safety concerns or policy violations.

8. Prohibited activities

You must not:

• Use the platform for any illegal purpose
• Provide false information or impersonate others
• Harass, abuse, or threaten other users
• Post fake reviews or manipulate ratings
• Scrape, copy, or distribute platform content without permission
• Attempt to bypass payments or circumvent our fee structure

9. Limitation of liability

eatby.ai is a marketplace and does not prepare food or employ cooks. We are not responsible for the quality, safety, or fitness of meals prepared by cooks. You use the platform at your own risk. To the maximum extent permitted by law, eatby.ai's liability is limited to the amount you paid for the booking in question.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the platform. Continued use of eatby.ai after changes become effective constitutes acceptance of the updated Terms.
